PetMagic Terms of Use

1. Provider and agreement

PetMagic is operated by Elastic Labs LLC, a US company; correspondence address: 2150 N Miami Ave, Apt 915, Miami, FL 33127-4944, United States. Contact Profile / Support or, without an account, https://petgpt.app/privacy-request. The privacy notice explains processing and separate optional choices. Effective date: October 10, 2026.

The iOS app licence is also governed by Apple’s Standard End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These service terms do not replace that licence or limit mandatory consumer rights.

2. Teen eligibility and account security

You must be at least 16 to use PetMagic and confirm this when accepting these Terms. If you are under 18, you need a parent's or guardian's permission for purchases where local law requires it. Store ratings do not establish contractual capacity or valid consent. Do not falsify your age or permission. Keep account information accurate, protect credentials and report unauthorized use. You are responsible for your conduct and authorized use, not a breach caused by our failure to meet a legal obligation.

3. AI results

PetMagic creates creative pet images/videos from photos, templates and instructions using external AI. Examples do not promise identical results. Outputs can contain artifacts, inaccuracies or similarities to others. They are not authentic evidence or veterinary advice. Review before use. We do not guarantee originality, copyright protection or freedom from third-party claims.

4. Content rights

You retain rights in uploads. You grant a non-exclusive permission to store, reproduce, technically modify, transmit to relevant processors and create derivatives only as necessary for requested features, results, related support and security, for no longer than those purposes and lawful retention require. This is not ownership transfer or a general advertising licence.

Obtain required rights and permissions from copyright holders and identifiable people. Do not upload sensitive records, identity documents or intimate material. Result commercial-use rights depend on law and the disclosed model licence. General acceptance does not authorize unrelated promotion with private photos or training a separate PetMagic model.

5. Prohibited use

Unlawful content, child sexual exploitation, non-consensual intimate imagery, animal cruelty, threats, harassment, fraud, impersonation, infringement and bypassing security or payment controls are prohibited. Do not misrepresent synthetic content as authentic evidence to deceive. Report violations to support with enough identifying information; do not resend illegal material unnecessarily.

6. PawSpark and charges

PawSpark is an internal unit for eligible features, not a deposit, investment or payment instrument outside PetMagic. Costs are shown before actions. Charged failed/cancelled generations use the refund process to restore eligible PawSpark. Internal credit differs from a store-payment refund. Report incorrect balances/statuses to support. Mandatory rights remain.

7. Purchases and subscriptions

Prices, periods, included features and renewal conditions appear in the purchase flow. Subscriptions may renew unless cancelled with the store/provider managing them. App/account deletion does not cancel Apple or Google subscriptions. Restore purchases through the supported account/store flow.

Refunds follow applicable law and payment-channel rules. These terms do not make all purchases non-refundable or waive statutory withdrawal/conformity remedies. Where immediate digital delivery needs separate express consent and acknowledgement of a lost withdrawal right, general acceptance is insufficient. Price changes do not authorize undisclosed retroactive charges.

8. Media availability

PetMagic is not permanent backup storage. Generation media may be removed after the indicated period; save results you want to keep. Link expiry, hiding a gallery entry, deleting a local file and server erasure are different. Recipients of files/links may retain or forward copies. Mandatory remedies for non-conforming services remain.

9. Restrictions and closure

Proportionate restrictions can address legal requirements, security risks or material breaches. Where appropriate and permitted, reasons and a support challenge path are provided. Immediate action may prevent harm. Restrictions do not automatically remove statutory refund rights. Account closure and privacy requests follow the privacy notice.

10. Liability and changes

We take reasonable care but cannot promise error-free AI, uninterrupted service or a specific creative outcome. Within lawful limits, we are not responsible for losses caused solely by unlawful user content, independent third-party acts or use contrary to clear instructions. Non-excludable liability, mandatory consumer remedies and liability for our own legally actionable misconduct remain. No unlimited consumer indemnity is imposed.

Material changes receive appropriate notice and renewed acceptance where required. Mandatory protections at your residence and access to competent courts/regulators remain. These terms create no undisclosed US forum, class-action waiver or mandatory arbitration.
